Driver Terms & Conditions

These Terms apply to anyone using the GetFood.com.au driver panel as a delivery driver (“the Platform”) to claim and deliver orders on behalf of a restaurant using our services. By logging in with a PIN, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.
1. Your Relationship — Read This Carefully
GetFood.com.au is a technology provider only. We build and operate the software a restaurant chooses to use to manage its own deliveries. We are not a delivery, logistics, or transport company, and we do not engage, employ, contract, direct, schedule, train, supervise, or pay drivers in any capacity.
You are not an employee, worker, contractor, agent, or representative of GetFood.com.au, in any jurisdiction, under any circumstances. Whatever your relationship is — employee, subcontractor, casual, volunteer, or otherwise — it exists solely between you and the restaurant. That restaurant, and that restaurant alone:
- Decides whether to give you access to the Platform at all
- Sets your PIN and controls when it’s issued, changed, or revoked
- Determines your pay, hours, expectations, and working arrangements, if any
- Directs, supervises, and is responsible for your conduct while making deliveries
GetFood.com.au has no involvement in, visibility into, or control over any of the above. Any dispute, claim, or question about your engagement — pay, conditions, termination, workplace rights, or anything else — is a matter exclusively between you and the restaurant, and must be directed to them, not to GetFood.com.au.
2. Access and Your PIN
Your PIN is issued and controlled entirely by the restaurant. You are responsible for all activity under it. The restaurant may revoke or change your access at any time, for any reason or no reason, without notice, and without needing GetFood’s involvement, approval, or agreement.
3. Using the Platform
The Platform shows you orders a restaurant has made available and lets you claim one to deliver. Claiming an order is a commitment — a short window exists to release it back if claimed in error, but once that window closes, you are expected to complete the delivery. GetFood.com.au provides the software only; how, when, and by what means you physically carry out a delivery is entirely your own decision and responsibility, made independently and without direction from GetFood.com.au.
4. Assumption of Risk
You acknowledge that delivery work inherently involves risks, including but not limited to traffic accidents, adverse weather, physical exertion, road hazards, interactions with the public, and vehicle-related incidents. You voluntarily and knowingly accept all such risks as part of choosing to undertake delivery work, regardless of who you perform that work for or under what arrangement.
5. No Liability
To the maximum extent permitted by law, GetFood.com.au excludes all liability for any injury, death, illness, property damage, loss, or other harm arising from or connected to your use of the Platform or your performance of a delivery, including where caused or contributed to by a restaurant, another driver, a customer, a third party, or your own actions. Nothing in this section is intended to exclude any liability that cannot lawfully be excluded under Australian Consumer Law or other applicable legislation, including liability for death or personal injury caused by negligence to the extent such liability cannot be lawfully excluded — but outside of that specific, legally-protected category, GetFood.com.au accepts no responsibility whatsoever for incidents arising from delivery activity.
You are solely responsible for maintaining any insurance appropriate to your circumstances (including vehicle, health, or income protection insurance). GetFood.com.au does not provide, arrange, or guarantee any insurance coverage for drivers under any circumstances.
6. Indemnity
To the extent permitted by law, you agree to indemnify and hold GetFood.com.au harmless against any claim, loss, damage, cost, or expense arising from your use of the Platform, your conduct while performing a delivery, or your breach of these Terms — except to the extent such claim arises from GetFood.com.au’s own negligence in operating the Platform itself (as opposed to anything occurring during or connected to an actual delivery).
7. Termination
The restaurant may end your access at any time, for any reason. GetFood.com.au may independently suspend or restrict Platform access at its sole discretion, including where use appears to breach these Terms or risk harm to any person, without needing the restaurant’s separate agreement to do so.
8. Changes to These Terms
We may update these Terms as the Platform’s driver features change. Continued use after an update constitutes acceptance of the revised Terms.
