Delivery Driver Terms & Conditions

For the purposes of this Agreement, “GetFood” refers to GetFood and its platform; “Delivery Driver” or “Driver” means the individual providing delivery services through the GetFood platform; “Order” means a customer order placed via the GetFood platform for delivery; and “Platform” means the GetFood mobile application and website used to facilitate delivery services.

By signing up and/or accepting delivery assignments via the GetFood platform, you agree to comply with these terms.


1. Driver Status and Legal Relationship

1.1 You acknowledge and agree that you are an independent contractor and not an employee, agent, or partner of GetFood.

1.2 You are solely responsible for your tax obligations, superannuation, and insurances, including public liability and vehicle insurance with appropriate coverage for food delivery activities, as many personal vehicle insurance policies do not automatically cover commercial or delivery use. You must ensure all applicable registrations, including an active Australian Business Number (ABN), are maintained.

1.3 You must not represent yourself as an employee or representative of GetFood.


2. Eligibility and Requirements

To be eligible to deliver with GetFood, you must:

  • Be at least 18 years old
  • Hold a valid driver’s licence (car, motorcycle, or bicycle as applicable)
  • Own or have legal access to a registered and roadworthy vehicle
  • Hold third-party or comprehensive vehicle insurance
  • Hold a valid right to work in Australia
  • Have an active Australian bank account
  • Maintain an active mobile number and internet-connected smartphone


3. Your Responsibilities

3.1 You are responsible for:

  • Picking up orders from partner restaurants and delivering them to customers in a timely and professional manner
  • Ensuring all food is handled hygienically and delivered without tampering or delay
  • Following road rules and maintaining safe conduct during deliveries
  • Maintaining up-to-date personal and vehicle details on the platform

3.2 You must not engage in fraudulent or dishonest conduct, including but not limited to falsifying delivery status, misrepresenting deliveries, or tampering with customer orders.


4. Use of Platform and Equipment

4.1 You must use your own smartphone and mobile data to access the GetFood driver application. GetFood is not responsible for data or device costs incurred.

4.2 You agree not to share your login details or assign delivery tasks to others.


5. Fees and Payments

5.1 You will earn a fee for each successfully completed delivery. The applicable rates are determined by GetFood and may vary depending on delivery distance, time of day, delivery zone, traffic conditions, and any active promotions. These rates are subject to change at GetFood’s sole discretion. You will be able to view the delivery fee offered for each order prior to accepting it, allowing you to make an informed decision.

5.2 Once you complete a delivery in accordance with the requirements of the platform, payment for that delivery is immediately credited to your GetFood driver account. These funds are available for withdrawal to your nominated Australian bank account in accordance with GetFood’s regular payment processing schedule.

5.3 You are solely responsible for meeting all taxation and reporting obligations associated with your earnings from deliveries. This includes, but is not limited to, income tax and Goods and Services Tax (GST), if applicable. GetFood does not withhold any amounts on your behalf and does not provide tax, legal, or financial advice. It is your responsibility to ensure that you comply with all relevant Australian tax laws and regulatory requirements. You are also responsible for ensuring your ABN registration remains active and appropriate for delivery services.

5.4 GetFood reserves the right to withhold or adjust payments if a delivery is disputed, incomplete, or under investigation due to suspected misconduct.


6. Termination and Suspension

6.1 Termination

Either party may terminate this agreement at any time, with or without cause, by providing notice in writing or via email.


6.2 Suspension and Deactivation

GetFood reserves the right to suspend or permanently deactivate your account if you:

  • Breach these Terms
  • Engage in fraud, misconduct, or unsafe behaviour
  • Fail to complete deliveries reliably and on time
  • Receive repeated substantiated complaints from customers or vendors


7. Unauthorised Conduct and Delivery Integrity

As a GetFood delivery driver, you are expected to carry out all deliveries in a professional, honest, and lawful manner. The following actions constitute a breach of contract and may result in immediate deactivation of your access to the GetFood platform, recovery of losses, and potential legal action:

  • Consuming, tampering with, stealing, or losing customer food or beverage orders
  • Failing to complete deliveries without a valid reason or notification
  • Marking an order as delivered without physically delivering the item to the customer
  • Knowingly providing false or misleading delivery updates or status
  • Abandoning an order without prior contact with support

If a delivery driver loses, consumes, tampers with, or fails to deliver an order without valid cause, they will be held fully responsible for the total cost of the order and any associated losses. GetFood reserves the right to recover these costs directly from the driver, including by withholding any outstanding delivery fees or incentives.

Any report or suspicion of such conduct will be investigated promptly. If the incident is confirmed:

  • The driver may be permanently removed from the platform
  • The driver will be held fully responsible for the total cost of the order and must reimburse GetFood accordingly
  • The driver may be reported to relevant authorities depending on the severity of the breach
  • Access to any outstanding delivery fees or incentives may be suspended or forfeited
  • All reports, including those from customers or vendors, will be subject to verification. Drivers will be given the opportunity to respond to any claims made against them.

We reserve the right to withhold payment for the affected delivery and any related incentives while an investigation is conducted.


8. Liability and Indemnity

8.1 You acknowledge that delivery work carries inherent risks and that GetFood is not liable for:

  • Loss or damage to your vehicle or equipment
  • Personal injury or death arising from your delivery activities
  • Fines, infringements, or legal costs you may incur

8.2 You agree to indemnify GetFood against all claims, liabilities, losses, and expenses arising from your performance (or failure to perform) delivery services.


9. Confidentiality and Privacy

9.1 You must not disclose or misuse any personal information or business details of customers, restaurants, or GetFood obtained during your engagement.

9.2 All customer and restaurant information must be used strictly for delivery purposes only and must comply with Australian privacy laws.


10. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through good faith discussions. If unresolved, the matter will be referred to mediation in Melbourne, Victoria before any legal proceedings.


11. Changes to Terms

We may amend these Terms from time to time. You will be notified of material changes, and continued use of the platform constitutes your acceptance of the updated terms.


12. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any legal disputes shall be resolved in the courts located in Melbourne.


13. Delivery Liability Acknowledgment

By accepting delivery assignments via the GetFood platform, you expressly acknowledge and accept full responsibility for the safe, timely, and complete delivery of all customer orders. You agree to reimburse GetFood for any costs or losses resulting from lost, tampered, consumed, or otherwise undelivered orders, as outlined in Clause 7.
